FDA Issues Warning Letter for Re-Importing Refused Product

FDA issued a Warning Letterto Roxy Trading, Inc., a food importer, for re-importing a product that had been previously refused entry by FDA for containing a non-permitted color additive. During a follow-up inspection FDA found that refused product that had been stamped “REFUSED Dec 11, 2008 FDA LOS-DO” and exported shortly after refusal was back in the United States with the “REFUSED” stamp deliberately manipulated to be removed from the master carton. While the product – Sweet Plait Biscuits – is not a seafood product, the warning letter is of interestfor the seafood communitybecause it reaffirms the agency’s laws and regulations outlining the responsibilities of importers and is an example of the agency taking action against fraudulent activities.
